General business terms online equity trading

Anyone accessing, viewing and using “DNB’s websites” (hereafter called User) is obligated to accept the following terms and conditions.

With your approved access to the DNB equity trading service, you are committed to familiarise yourself with functions and risks before you trade. Our content is not to be regarded as recommendations for investments, you must make your own investment decisions.

These terms apply to the use of websites and/or other electronic media managed by DNB Bank ASA (and/or its subsidiaries and affiliated companies) ("DNB's websites") in connection with equity trading.

Conditions for use of our websites

The content of “DNB’s websites” is not to be considered as a recommendation to invest or engage in any transaction. Relevant, concrete and professional advice should always be sought before any investment decision is made. “DNB’s websites” cannot be held to constitute the basis for such a decision.

The User should be aware of the risks of loss when investing and trading financial instruments and other related products. All decisions are made by the User at his or her own choice and liability.

DNB shall not be held responsible for the information on “DNB’s websites” being correct, complete or accessible.

Information may be delivered by third parties and errors and incorrect information may arise, both technical,qualitative and quantitative. The User can therefore not hold DNB, third parties or other sources accountable for incorrect or lacking information in using “DNB’s websites”. The information will be presented with a delay and cannot be expected to be in real-time.

The information and immaterial rights to the information will mostly be owned by the specific source. Anyone using this information is obligated to respect the owner of the copyright, and hereunder DNB's rights.

The User acquires no rights to the information available on “DNB’s websites” and cannot use the information for other purposes than personal, non-commercial use. Other use, such as communicating or selling the information to others, is prohibited, regardless of whether the information is processed or in the form of raw data.

All information on “DNB’s websites” is strictly intended for citizens living in Norway or companies in Norway. All material accessible on “DNB’s websites” is not intended to be used by any other person or company located outside Norway, EEA-states, in the USA, Canada, Japan, Australia or any other state where this information is accessible.

Any dispute or disagreement that may arise from the use of “DNB’s websites” is to be resolved pursuant to Norwegian law, with the Oslo District Court as the legal venue.

Any breach of these terms will be prosecuted.

ADDITIONAL TERMS

CME Indexes may discontinue or change the Dow Jones IndexesSM, or their availability to you, at any time without notice. If any provision in these Terms and Conditions of Use is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. These Terms and Conditions of Use, your rights and obligations, and all actions contemplated by this agreement shall be governed by the laws of the State of New York, as if these Terms are a contract wholly entered into and wholly performed within the State of New York.

These Terms and Conditions of Use constitute the entire agreement between you and CME Indexes relating to the Dow Jones IndexesSM, and they supersede any and all other agreements, oral or in writing, with respect to the indexes. The failure of CME Indexes to insist upon strict compliance with any term or provision shall not be construed as a waiver with regard to any subsequent failure to comply with such term or provision. Certain market data is provided by Reuters for use in calculating the Dow Jones IndexesSM. Reuters shall not be liable for any errors or delays in content, or for any actions taken in reliance thereon. The Dow Jones IndexesSM are proprietary to and distributed by CME Indexes and have been licensed for use. "Dow Jones Indexes" is a licensed trademark of CME Indexes and is a proprietary service mark of Dow Jones Trademark Holdings LLC.
